GENERAL TERMS OF BUSINESS OPERATIONS IN THE INTERNET TRADE
University of Rijeka, Faculty of Medicine, Center for Proteomics (hereafter as the Seller) is a legal entity that produces, markets and ships its products on the Web shop products.capri.com.hr (hereinafter referred to as the Web shop).
The Buyer is any legal or natural person whose headquarters / place of residence is located worldwide, and who makes orders through the Web shop.
Web shop’s terms of business comply with the Consumer Protection Act of the Republic of Croatia (Official Gazette 41/2014, 110/2015, 14/2019), Chapter III. – Contracts concluded outside business premises and at a distance, from Article 57 to Article 79. The Terms of use of the Web shop are subject to change at any time; therefore, the Web shop Terms of use should be read each time the Buyer visits the Web shop. If the Buyer continues to use the Web shop after the Terms of use have been modified, (s)he/it agrees to be bound by the new Terms of use.
Products offered through the Web shop are for laboratory research only, not for human or medical use.
All prices are quoted in EURO without VAT. If the Buyer is from one of the Member states of European Union, VAT is not charged pursuant to Art. 41 of the VAT Act of the Republic of Croatia. If the Buyer is from a country that is not a member of European Union, the VAT is not charged pursuant to Art. 45 of the VAT Act of the Republic of Croatia. The prominent prices in the Web shop are only valid for online purchase. Prices displayed in the Web shop exclude transportation.
By registering on this Web shop, the Buyer acknowledges that (s)he/it is fully acquainted with and accepts this Terms of use.
REGISTRATION AND ORDER
To make a purchase on the Web shop, registration is not required. It is necessary for the Buyer to leave a valid e-mail address (the one with access), personal information (name, surname, address, postal code, place, phone number), billing and shipping address in the first step of the checkout process, so that an order confirmation can be received after entering the data needed to perform the delivery.
If a Buyer does not want to enter the delivery address or payment information each time during the purchase, a quick registration is recommended. It is only necessary to enter a valid e-mail address, personal information (name, surname, address, postal code, place, mobile number) and password to access the user account. It can be an arbitrary string of characters – longer, more resistant to hacking.
After entering the requested data, registration must be confirmed by clicking the “Registration” field. The created user account remains registered in the system, and is accessed by a combination of user name and password on the “Login” page.
In case of forgotten password, click on “Forgotten Password” on the same page. Go to the page and enter the e-mail address used previously for registering on the Web shop. The system automatically sends a link by which password will be reset and a new one is assigned. The password can be changed later in account settings since automatically created passwords are not easy to remember (or just click on “YES” when the browser asks to remember the entered password).
In short, after creating an account, for any further purchase, only a login with a user name and a password is required.
Product ordering is possible within 24 hours a day, 7 days a week.
The Buyer orders the product(s) through an electronic basket, so when (s)he/it completes the shopping process in our Web shop, (s)he/it will receive an e-mail with all the information about the ordered products, the price and the payment method, which is also a confirmation that the order was received.
The Buyer is responsible for the accuracy of the information stated in the order.
Orders are processed every working day from 8 am to 4 pm. Orders received after 4 pm or at weekends will be processed the first following working day.
ORDER CANCELLATION PROCEDURE
The Buyer may cancel the order without stating the reason within fourteen (14) business days (according to the Article 72 of the Consumer Protection Act) from the acceptance of the received Sellers’ quotation. The Buyer must notify the Seller solely in writing to the below mentioned contact information. The order is considered to be canceled when the Seller receives a written notice.
If the Buyer cancels the order at the time the package with the ordered product(s) has already been sent, the Buyer is obliged to accept it and return it to the Seller within 7 days from the receipt in the same condition following the requirements for shipment of the purchased goods. The returning product(s) must be complete, in original and non-defective packaging with all relevant undamaged parts. The used and damaged products cannot be returned.
The costs of returning the ordered products will be borne by the Buyer.
If the Buyer ordered one or more items of goods to be delivered separately, i.e. in the case of goods delivered in more than one piece or more, the time limit referred to in paragraphs 1 shall begin from the day on which the Buyer or third person designated by the buyer who is not a carrier, has received the last piece or last consignment of goods.
The Buyer is not entitled to cancel the order under Article 79 of the Consumer Protection Act in case the price of the item listed in the order depends on the changes that have occurred in the financial market that are not under the influence of the Seller, but have occurred within the period the Buyer has the right to unilaterally cancel the contract.

Cancelled orders will be processed every working day from 8 am to 4 pm.
PAYMENT
Buyer’s order together with these Terms of use, is a prior notice within the meaning of Article 57 of the Consumer Protection Act.
The Seller accepts PAYMENT BY WIRE TRANSFER ONLY.
Terms of payment are 30 days net.
The Buyer is requested to report the received invoice number on each payment and to pay the full amount of the invoice without deducting bank fees. The Buyer is responsible for any correspondent and/or intermediary bank transaction fees.
SHIPPING AND STORAGE
In the purchase process, the Buyer is asked to state if (s)he/it wishes to provide its customer account of any courier service if preferred. If the account is not stated, the Seller will choose the best and economically viable international courier service to ship the Buyer’s order. Shipping and delivery are usually done by the international courier services of TNT, UPS, DHL, FedEx or World Courier depending on the terms of shipping and storage.
The delivery time at the Buyer’s address is usually within two weeks from the order confirmation date, depending on the destination.
Products are sent packed in cardboard or Styrofoam boxes on ice packs, so that they cannot be damaged by conventional manipulation in postal traffic. If the products require shipping at room temperature or with dry ice, the Buyer should indicate it on purchase order . Sodium azide can be added upon request.
During the takeover, the Buyer is obliged to check for any damage and immediately advertise to the courier who delivered the goods, or refuse to receive the shipment with visible external damage. If the Buyer has not received the ordered goods or the delivery notice from the Seller after the scheduled delivery deadline, s(he)/it must notify the Seller in order to take the action to track the shipment or to send the replacement.
If the Buyer refuses to receive the correct and undamaged goods that (s)he/it ordered, the Seller has the right to request from the Buyer the reimbursement of all manipulative delivery costs.
In the event that the ordered item is not in stock, the Seller will contact the Buyer as soon as possible, offering the options of waiting for the arrival of the item, or replacement for another suitable item. The Seller reserves the right not to deliver goods based on orders with incomplete and / or incorrect information.
In the event that the product cannot be delivered by the Seller because the product is not in stock, the Seller will notify the Buyer, who can then cancel the order or accept the new delivery due date in writing. If the Buyer decides to cancel the order prior to shipment, the Buyer needs to notify the Seller at least 2 days before shipment. CLAIMS
In case the ordered product does not function as expected based on the data provided on the web shop, the Buyer can send a claim with detailed explanation on the undertaken procedures and evidence that the product is not functioning.
The Seller undertakes in each such case to consider a specific situation and offer the customer a variant of the solution.
Claims for missing or damaged items must be reported directly to the Seller within 5 days of the receipt of the order, and refer to:
- purchase order number
- shipment date
- detail and photographic evidence of damage to packaging and/or reagent vials.
All claims associated with damaged packaging must be reported immediately to the local courier and to the Seller. Please retain all packaging and product evidence.
All requests to return product(s) must be authorized by the Seller. For products returned due to customer ordering errors we reserve the right to apply handling and/or restocking charges. Return requests must be made within 7 days of receipt.
The Buyer can file a complaint about the quality of services or goods in written form filling Troubleshooting form.
The response to Buyer’s claims will be made in writing no later than 10 days from the date of receipt of the claim.
GUARANTEE OF PRIVACY
The Seller is obligated to keep the privacy and confidentiality of personal data of all Buyers, in accordance with the Implementation Act of the General Data Protection Regulation.
All employees of the Seller are obligated to comply with the principles of privacy and confidentiality of data. The Seller collects only the necessary, basic information of the Buyer and informs the Buyer about the way they are used. The Seller regularly gives Buyers the choice of using their data, including the ability to decide whether or not to remove their name from the lists used for marketing campaigns.
Personal customer data are stored on a secure server and are only available to the employees of the Seller, to whom these data are necessary to provide quality service to the customers. The use of data is limited to communicating with Buyers for the purpose of performing sales transactions, and informing users of the novelties and benefits available to them through the Web shop.
The Seller guarantees that the personal data of the users of the Web shop will never be given for inspection and use to a third party without the prior express consent of the user. This shall exclude the inspection by the authorized services of the executive state authority of the Republic of Croatia for the purposes of investigative actions on the basis of a valid court order.
By registering, you confirm the accuracy and completeness of the above mentioned data form, and you expressly agree that the Seller may, in accordance with the provisions of the Implementation Act of the General Data Protection Regulation, process the personal data indicated in the form for the needs of their own records and provide information services on new products and services.
LEGAL PROVISIONS
The Web shop contains information about products offered by the Seller and serves as an electronic sales point. The Seller cannot assume responsibility for any damage resulting from the use of information from these pages for purposes that go beyond their intended purpose. The Seller undertakes to apply all reasonable security measures in order to protect the interests of the Buyer and to prevent any possible misuse.
The Seller cannot be held responsible for misconduct that cannot be ascertained as a consequence of a technical failure of the Internet trade system or employee’s fault. RESOLUTION OF DISPUTE
The Seller and the Buyer will endeavor to settle any disputes by agreement and by peaceful means, otherwise the competent court in Rijeka is in the jurisdiction.
PROTECTION OF COPYRIGHT
All contents published in this Web shop are protected by copyright and can be used only under the conditions prescribed by the Law.
CHANGES
The Seller reserves the right to modify, supplement or remove any part of this Web shop at any time. Changes shall come into force by publication on this Web shop or when the users have been notified of them.
IMPROVEMENT OF THE SERVICE QUALITY
The Buyer is invited to fill the Customer Satisfaction Form for the purposes of improvement of the Seller’s services.
